The hiring contract shall be between the hirer and the owner of the property
and shall be deemed to be made subject to these Conditions of Hire. The Contract
of Hire is not effective until the owner despatches to the hirer written confirmation
of a booking.
Bookings will be confirmed upon receipt by the owner of the required deposit
payment.
The balance will be payable 8 weeks before commencement of the hire.
If the booking is made within eight weeks of the hire commencement date the
full charge will be payable upon booking.
Once a confirmation of booking has been made by the owner; the hirer is responsible
for the total published price of the property as shown on the confirmation.
Any cancellation made by the Hirer (for whatever reason) shall be in writing
to the owner at the address shown on the booking form. so long as written notice
of cancellation is received not less than 10 weeks before commencement of the
hire, Hirers will not be held liable to pay the full balance of the hire. On
receipt of such cancellation the owner will endeavour to relet the accommodation
for the entire period of the original booking.
If the owner is successful in reletting for the entire period originally booked
at the original contracted price, all monies due (whether by way of deposit or
otherwise) less a handling charge of £50.00 will be refunded.
If the owner shall only succeed in reletting the accommodation for a proportion
of the period originally booked, or at a lower price than that originally
contracted, that proportion of monies due (by way of deposit or otherwise)
less a handling charge of £50.00 will be refunded.
If the owner shall be unable to relet the accommodation at all then all then
all monies due (whether by deposit or otherwise) will be forfeit to the owner.
For weekly lets arrival and departure is on Saturdays. The property is available
from any time after 4pm at the commencement of a hire and must be vacated by
10am on the day of departure.
Baggage and personal belongings are at the Hirers risk at all times, and no
responsibility can be accepted for loss or damage to any vehicles or their contents.
Under no circumstances may more than the maximum number of eight persons plus
one infant occupy the property except by prior written agreement with the owner.
Where booking is made for less than eight persons this is then the maximum permissible
party size for that booking. The owner reserves the right to refuse admittance
or ask the hirer to leave if this condition is not observed. In addition the
owner reserves the right to refuse or revoke any booking from parties which
in their opinion (and at their sole discretion) be unsuitable for the property
concerned.
The Hirer is responsible for the property and all fixtures fittings furniture
and equipment in or on the property and agrees to keep it in a like state of
repair and condition as at the commencement of the hire. All damages and breakages
are the legal responsibility of the Hirer and their cost is refundable upon
demand. All damage or breakages must be reported to the owner or their agent.
The property and all fitments furniture utensils and equipment etc must be left
clean and tidy at the end of the hire period.
The damage deposit will be refunded within 14 days of the end of the hire subject
to the property being vacated in a reasonable condition. Hirers will be notified
in wirting of any charges made as a result of damage to the property, its fixtures
or fittings. Payment of the damage deposit does not remove liability from the
hirer for any costs over and above that of the deposit.
The Owner or their representative shall be allowed access to the property at
any reasonable time during the hire.
Smoking is not permitted in or on any part of the property
by any person. The Owner reserves the right to refuse admittance or ask a Hirer
to leave if this condition is not observed.
As a condition of our insurance, candles, oil burners, insense burners, joss
sticks or other naked flames may not be used on the premises.
Any dispute arising between the Owner and Hirer which cannot be mutually resolved
shall be referred to a single arbitrator to be agreed or if no such agreement
is reached to the President of the Law Society of Scotland. In either case such
arbitration would be in accordance with the Laws of Scotland.
The hiring contract is made on the understanding
that the property will be available for the dates stated. In the unlikely event
the property is not available through events outside the owners control (eg
fire theft damage drought or similar) the owner may be forced to cancel the
booking. The Hirer will be advised of such circumstances as early as possible.
In such circumstances the Owner will refund the Hirer in full but the Hirer
will have no further claims against the owner.
